Divorce and Infants
Does anyone have experience with divorce and infants? I am wondering what the laws are concerning custody and visitation. I know someone with a baby who is contemplating divorce, but is afraid to make the leap because her husband cant take care of the baby when he has someone there to help. And she is scared to death of leaving the baby with him. So she is terrified of getting a divorce and him having unsupervised visitation.

I think the laws differ from state to state. Now I am not a lawyer or anything so I am not positive, but I think to require supervised visitation he would have to be proven in court to be unfit.

I wonder how difficult that would be. He is unfit, but I dont know if he would be considered so by the courts standards.

When my ex and I split up I was pregnant. He didn't want to be a parent. He has never seen his daugther but I still inquired about what is rights would be if he wanted visitation or custody. In my area they said that mothers are almost always granted primary custody of the baby unless she does something really bad (abuse, drugs, etc). I was also told that if he petitioned for visitation they would probably not be very much when she was young (infant, toddler) and especially so if breastfeeding. .

That is encouraging. I will certainly pass that on. She is breastfeeding, so that should help her case a bit. Thank you.

I dont know why does some people dont want to be parents? if they reallY do not have any intention of having children then why do they get engaged in life? they should stay single. but whatever, its good that mothers are given more priority for their children.
